Ala. Code § 32-5A-170 (1975)

Acts 1980, No. 80-434, p. 604, §8-101.

Alabama Code § 32-5A-170 outlines the regulations regarding speed limits and safe driving practices in various circ*mstances. This statute essentially emphasizes the need for drivers to operate their vehicles at speeds that are reasonable and prudent considering the conditions, hazards, and specific situations on the road.

Let's break down the concepts involved here:

  1. Reasonable and Prudent Speed: This refers to the responsibility of drivers to maintain a speed that is not only within the legal limits but also suitable for the conditions they're driving in. It involves considering factors such as weather, road conditions, visibility, and traffic flow.

  2. Safe and Appropriate Speed in Specific Scenarios:

    • Approaching and Crossing an Intersection or Railroad Grade Crossing: Drivers need to reduce speed when nearing intersections or railroad crossings to ensure they can stop safely if necessary.
    • Going Around a Curve: Reduced speed is necessary when navigating curves to maintain control and prevent accidents.
    • Approaching a Hill Crest: Speed should be moderated when approaching the top of a hill to ensure visibility and be prepared for any obstacles or changes in road conditions.
    • Traveling on Narrow or Winding Roadways: In these scenarios, maintaining a reduced speed is crucial for safety due to limited visibility or space.
    • Special Hazards Existence: If there are any unique hazards like pedestrians, extreme weather, or unexpected conditions, drivers must adjust their speed accordingly to prevent accidents.
  3. Legal Basis - Alabama Code § 32-5A-170: This section of the Alabama legal code outlines these specific speed regulations and the expectations placed on drivers to maintain safe speeds relative to different road conditions and hazards.
